We spoke with a client who started their small practice helping other small business. Business was good! Yay! The number of employees grew because business was good. Yay! Wait a minute.
Who is being mindful of labor costs containment, overtime, hiring of new labor,
and defining overtime pay? Well, with only 10 employees that was not the
biggest challenge everyone wanted to work together and stay as late as needed
to help the business grow. Three years later and that business went from 10 to 1000- fold. And so the story goes, now who is determining white color salaried (exempt) versus non-exempt labor?
In general, overtime rules require employers to pay employees at least
time-and-a-half their regular pay rate for hours worked exceeding
40 in a workweek, unless they are exempt. The sets these federal
standards, but individual states can have their own overtime laws that may be more generous.
